1. Introduction

Welcome to TrendSwap (accessible at trendswap.app). TrendSwap is an AI-powered creative video platform that transforms authorized portrait photographs into dynamic, viral-style short video clips (the "Service").

These Terms of Service (the "Terms") constitute a legally binding agreement between you ("you," "user," or "creator") and TrendSwap ("we," "us," or "our"). These Terms govern your access to and use of our website, the AI Studio, our credit passes, and all related services.

Please read these Terms carefully before using the Service. By accessing our website, creating an account, uploading photographs, or purchasing video credits, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must immediately discontinue your use of the Service.

2. Eligibility

To use TrendSwap, you must be at least 18 years of age or have reached the legal age of majority in your jurisdiction. By accessing or using the Service, you represent and warrant that you meet this requirement and possess the legal capacity to enter into these Terms.

The Service is strictly intended for adult creators and users. If you are accessing the Service on behalf of an organization or legal entity, you represent and warrant that you have full authority to bind that entity to these Terms.

3. Description of the Service & AI Video Generation

3.1 Creative Motion Drops

TrendSwap provides an AI video generation studio that pairs a single authorized adult still portrait with preset creative motion templates (such as Burning Bridges, Bulin 47, Topo Gigio, and Zombie Couple). You can explore active templates in our trending roster.

The Service operates exclusively with our curated scene templates; we do not accept or process custom third-party reference videos.

3.2 Unpredictable Nature of AI Outputs

The AI Studio displays a framing preview upon selecting an image. This framing preview is a static alignment guide, not a video simulation.

Our Service relies on advanced artificial intelligence and generative machine learning models to synthesize facial movement, lighting, and scene dynamics. Due to the complex and unpredictable nature of generative AI:

  • The final rendered video may vary in facial expressions, motion cadence, ambient lighting, and artistic nuances compared to the still preview or reference examples.
  • Generative AI outputs are delivered on an "as is" basis, and minor visual artifacts or variations are normal characteristics of automated AI video synthesis.
  • Video generation requires cloud computing resources; processing and queue times may fluctuate based on current server demand.

4. User Content & Intellectual Property

4.1 Ownership of User Content

You retain ownership of any photographs, images, or materials that you upload to the Service ("User Content"), as well as the rights granted to you in the video clips generated from your authorized inputs ("Generated Content"). You are solely responsible for all User Content you upload and all Generated Content you produce or share.

4.2 Limited License to TrendSwap

By submitting User Content to TrendSwap, you grant us a worldwide, non-exclusive, royalty-free, limited license to host, process, reproduce, and adapt your image solely for the purpose of operating, rendering, and delivering your requested AI videos and providing customer support. We do not use your personal likeness to train public foundational AI models without your express consent.

4.3 TrendSwap Intellectual Property

All intellectual property rights in the TrendSwap website, the AI Studio interface, our brand name, logos, website designs, and proprietary software belong exclusively to TrendSwap and its licensors. You may not decompile, reverse engineer, scrape, or extract our code, templates, or underlying infrastructure without prior written permission.

5. Strict Content Restrictions & Acceptable Use

To maintain a safe, lawful, and responsible creative platform, all users must adhere strictly to the following content restrictions. These rules apply to any content uploaded, generated, or shared on TrendSwap.

5.1 Prohibited Content

You agree not to upload, generate, or distribute any content that:

  • Involves Minors: Depicts or involves minors (individuals under 18 years of age) under any circumstances whatsoever.
  • Is Illegal or Fraudulent: Promotes, facilitates, or engages in unlawful activities, scams, or fraudulent schemes.
  • Is Sexually Explicit or Violent: Contains nudity, pornography, sexual abuse, graphic violence, or animal cruelty.
  • Contains Hate Speech or Harassment: Incites violence, hatred, discrimination, defamation, bullying, or threats against individuals or protected groups.
  • Infringes Third-Party Rights: Infringes upon copyrights, trademarks, publicity, or intellectual property rights of others.

5.2 Specific Restrictions for AI-Generated Video

When using our AI video generation features, you strictly agree:

  • No Unauthorized Likeness: You may not upload or use any photograph, likeness, or image of another person without that individual’s explicit, informed, written permission.
  • No Celebrities or Public Figures: You may not upload photographs of celebrities, artists, politicians, or public figures without verified contractual authorization.
  • No Malicious Deepfakes or Impersonation: You may not generate synthetic media intended to mislead, defraud, black-mail, or deceive the public, nor impersonate any real person or entity.
  • No Misleading Endorsement: You may not present AI-generated videos as factual real-world events or as endorsed by any real person or organization without authorization.

5.3 Enforcement & Immediate Termination

We actively monitor platform integrity and enforce these restrictions swiftly:

  • We reserve the right to remove any content, cancel ongoing generation jobs, and suspend or permanently terminate accounts found in violation, without prior notice.
  • Any violation of our likeness or minors policy will result in immediate forfeiture of all remaining credits and fees paid, with zero refund.
  • We cooperate fully with law enforcement authorities regarding any unlawful content or non-consensual imagery.

6. Credit Passes, Billing & Automatic Fail-Safe Recovery

6.1 One-Time Credit Passes

TrendSwap operates on a flexible, upfront credit pass system. Our credit passes are one-time purchases, not recurring subscriptions. You will not be billed automatically without an explicit checkout action.

Available passes on our pricing page include:

  • Creator Pass (Single Pass): $9.90 for 50 credits (up to 720p HD).
  • Creator Trio (Trio Pass): $24.90 for 150 credits (unlocks 1080p Full HD).
  • Creator Party (Party Pass): $59.90 for 400 credits (full 1080p Full HD Pro).

6.2 Credit Consumption & Validity

  • 480p Resolution: 25 credits per generation.
  • 720p HD Resolution: 50 credits per generation.
  • 1080p Full HD Resolution: 100 credits per generation (requires a Trio or Party pass unlock).
  • No Expiration: Purchased credits attached to your account do not expire and remain available until used.

6.3 Automated Fail-Safe Credit Recovery

AI video generation relies on cloud computing clusters that may occasionally encounter unexpected timeouts or upstream rendering interruptions.

  • If a generation job terminates with an error or fails to complete delivery, the exact credits charged for that attempt (25, 50, or 100 credits) are automatically returned to your TrendSwap balance.
  • Returned credits are available immediately for another creation attempt.

6.4 Refund Terms

Because AI video generation incurs immediate, irreversible cloud computing costs upon successful processing:

  • Fees paid for successfully generated videos are non-refundable.
  • Automatic credit returns to your balance serve as the primary remedy for failed jobs.
  • Requests for monetary card refunds (e.g., in cases of accidental duplicate billing or uncredited charges) are evaluated under our Refund Policy. For billing inquiries, contact support@trendswap.app.

7. Third-Party Music & Creative Inspiration Disclaimer

TrendSwap is an independent creative studio and fan tool inspired by viral internet trends, memes, and digital culture.

TrendSwap is NOT affiliated with, sponsored by, or endorsed by any recording artists, public figures, music publishers, or record labels whose iconic moments or trends may have inspired our visual presets.

Purchasing a video pass pays for AI computing power and rendering services only. It does not convey commercial synchronization rights, master recording licenses, or public performance rights to any background audio or third-party content. When sharing your creations on social platforms like TikTok, Instagram, or YouTube, you are solely responsible for complying with the platform's music licensing and AI-content disclosure policies.

8. Video Retention, User Deletion & Asset Management

8.1 User-Initiated Video & Asset Deletion

TrendSwap provides direct self-service asset management controls within your account. You have the right and ability to delete your generated video clips and associated media assets directly from your account library (in My videos).

When you delete a video or generation record from your library:

  • The associated video files, thumbnails, and rendering assets are permanently removed from active cloud storage.
  • Once deleted, this action is permanent and cannot be reversed or restored.
  • Deleting a completed video does not refund the video credits consumed for its generation, as computational resources were already expended during rendering.

8.2 Download Responsibility & Storage Lifespan

TrendSwap is an AI video generation studio, not an indefinite backup vault. While your generated clips remain accessible in your library until you choose to remove them, we strongly advise you to promptly download and save your completed videos to your local device. We reserve the right to archive or clean up historical files in accordance with reasonable cloud storage lifecycle policies.

9. Disclaimers & Limitation of Liability

9.1 Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TRENDSWAP EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, NOR THAT GENERATED VIDEOS WILL MEET YOUR SUBJECTIVE EXPECTATIONS.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRENDSWAP, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL TRENDSWAP'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS EXCEED THE AMOUNT YOU ACTUALLY PAID TO TRENDSWAP IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100 USD), WHICHEVER IS LESS.

10. Indemnification

You agree to defend, indemnify, and hold harmless TrendSwap, its affiliates, directors, officers, and employees from and against any claims, damages, liabilities, losses, and legal expenses arising out of or related to:

  • Your violation of these Terms;
  • Your violation of any third-party rights, including likeness, privacy, publicity, or intellectual property rights;
  • The photographs or User Content you upload or videos you generate and distribute.

11. Termination

We may suspend or terminate your account or access to the Service at any time, with or without notice, for conduct that violates these Terms or harms other users, third parties, or the platform. Upon termination, your right to use the Service ceases immediately.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When updates occur, we will revise the updated_at date at the top of this page. Substantial changes may also be announced via our website or email. Continued use of the Service after modifications become effective constitutes acceptance of the updated Terms.
